Safety and Liability Waiver

Safety and Liability Waiver

Unit 12a, Birch Copse, Technology Road, Poole BH17 7FH, United Kingdom

IMPORTANT: This document is a legally binding agreement. Please read it carefully before signing or agreeing (including via online booking or membership purchase). By accepting this waiver, you acknowledge that you understand and agree to the terms below. If you are under 18, a parent or legal guardian must sign on your behalf.

1. Assumption of Risk

Combat sports and martial arts training at Gorilla Fight Team involve inherent risks. By participating (or allowing your child to participate), you acknowledge and accept the following:

Inherent Danger: Activities such as Mixed Martial Arts (MMA), Brazilian Jiu-Jitsu (BJJ), K1 Kickboxing, wrestling, and related training are physically and mentally strenuous. They involve close physical contact, high-impact movements, and the risk of falls or collisions, which can result in injury.

Range of Injuries: You understand that injuries are common in combat sports. Minor injuries (bruises, bumps, scrapes, and soreness) occur frequently. More serious injuries are possible, including sprains, strains, dislocations, or broken bones, which may occur infrequently but are a known risk. In rare cases, severe or catastrophic injuries can occur – such as concussion, serious head or spinal injuries, permanent disability, paralysis, or even death.

Health Risks: You acknowledge that intense physical exercise can aggravate existing medical conditions or cause sudden illness. You also recognise that close contact training can spread illnesses or infections (for example, colds, flu, skin infections).

Voluntary Participation: You are voluntarily engaging (or permitting your child to engage) in these activities with knowledge of the dangers involved. You agree to participate at your own risk, and you accept full responsibility for any injury, loss, or damage that may result from training at Gorilla Fight Team.

Instructor Expertise: You acknowledge that Gorilla Fight Team’s instructors, Damo and Darren, are experienced fighters and qualified coaches who will endeavour to teach safely. However, their expertise does not and cannot eliminate the inherent risks of combat sports. You agree that you will not interpret their guidance or experience as a guarantee of safety.

2. Health and Medical Fitness to Train

By signing this waiver, you confirm the following regarding your (or your child’s) health:

Medical Certification: You represent that you (or your child) are medically and physically fit to participate in combat sports training. You have no known medical conditions or injuries that would make participation unsafe or pose a risk to yourself or others.

Consultation with Doctor: If you have any doubts or health concerns, you have consulted a doctor (GP) or medical professional and received clearance to participate. It is recommended that all participants consult their doctor before starting any new intensive exercise programme.

Ongoing Health Obligations: You agree to inform Gorilla Fight Team of any relevant health issues, injuries, or conditions that arise in the course of training. If any condition changes (such as pregnancy, injury, or newly diagnosed illness), you will inform the instructors before continuing training.

No Substance Impairment: You confirm that you will not participate while under the influence of alcohol, illegal drugs, or any medication that could impair your judgment or physical ability.

3. Code of Conduct and Behaviour

Gorilla Fight Team is committed to providing a safe, respectful, and disciplined environment. By participating, you (or your child) agree to adhere to the following Code of Conduct:

Follow Instructions: Obey all instructions and guidance from coaches and staff at all times. Use equipment and perform techniques only as directed by the instructors. If you are unsure about any technique or exercise, you will ask for clarification before proceeding.

Safety Gear: Wear appropriate attire and required safety equipment for each class (for example, mouthguards, gloves, headgear, etc., as advised by instructors). Failure to wear proper gear may result in being unable to participate in certain activities.

Respect and Sportsmanship: Maintain respectful behaviour towards coaches, fellow students, and visitors. Unsportsmanlike conduct, harassment, bullying, discrimination, or abuse of any kind will not be tolerated. This includes offensive language, dangerous aggressive behaviour beyond the scope of training, or any form of intimidation.

No Disruptive Behaviour: Avoid behaviour that disrupts classes or jeopardises the safety of others. This includes horseplay, ignoring instructor commands, or using techniques with intent to harm rather than learn.

Cleanliness and Hygiene: Observe proper hygiene for the health of all participants. Keep training gear clean, and if you have any communicable condition (e.g. skin infection), inform the staff and refrain from training until cleared.

Zero Tolerance Policy: Gorilla Fight Team has zero tolerance for unsafe, violent, or grossly inappropriate behaviour. The gym reserves the right to refuse service, eject, or terminate the membership of any participant (without refund) who violates the code of conduct or endangers others. You agree that such decisions may be made at the sole discretion of the staff for the safety of the community.

4. Classes and Age Restrictions

Gorilla Fight Team offers a variety of classes in combat sports, some of which are designed for adults and others for children. By signing this waiver, you acknowledge and agree that:

Certain classes or training sessions (for example, advanced MMA sparring or K1 Kickboxing sessions) are only suitable for adults and will not be open to minors. The gym will clearly indicate which classes are for adults (18+) and which are available to juniors or children.

Children (under 18) may only participate in classes that are designated for their age group or explicitly open to youth. As a parent/guardian, you agree to ensure that your child attends only age-appropriate classes. You will follow the gym’s guidance on which classes your child can join, and you will not seek to enrol them in adult sessions that are deemed unsuitable.

You accept that not all combat disciplines offered are appropriate for children, and that Gorilla Fight Team has the right to determine participation eligibility for each class. This is for the safety and well-being of younger participants.

In mixed-age environments (such as family sessions or open mat periods, if any), children must be supervised by a coach or a responsible adult, and parents/guardians are expected to oversee their child’s behaviour in line with the Code of Conduct.

5. Photography and Media Release

Gorilla Fight Team may occasionally take photographs or video footage during training sessions, classes, or events for promotional and marketing purposes (such as social media posts, the gym’s website, or flyers/brochures). By participating, you consent to the following:

Permission to Use Images: You grant permission to Gorilla Fight Team to capture and use photographs and video of you (or your child) during training or events. This includes group photos, action shots during classes or sparring, and any other candid or posed training-related images.

Promotional Use: You agree that these images/videos may be used, re-used, and published in any format (print, digital, video, etc.) for lawful promotional purposes. This may include Facebook, Instagram, the gym’s official website, newsletters, posters in the gym, or other promotional material showcasing Gorilla Fight Team’s activities.

No Compensation or Approval: You understand that you (or your child) will not receive any compensation for the use of these images or footage. Gorilla Fight Team shall own all rights to the media for the purposes described. You waive any right to inspect or approve the finished product wherein your likeness appears.

Opt-Out (If Required): If you do not want you or your child’s image to be used for such purposes, you agree that it is your responsibility to notify Gorilla Fight Team in writing. In the absence of such a notice, this media release is effective for the duration of your participation at the gym and thereafter for any media captured during that time.

6. Emergency Medical Consent

Your safety is our priority. In the event of an injury or medical emergency during training, the following terms apply:

Authorisation of Treatment: You hereby authorise Gorilla Fight Team staff and instructors to administer first aid if you (or your child) suffer an injury, and to seek medical treatment or call for medical assistance (for example, calling an ambulance or arranging transport to a hospital) on your behalf if needed.

Emergency Contact: You should provide an emergency contact name and number (for yourself or your child) to the gym. In the event of an emergency, the staff will attempt to contact that person as soon as reasonably possible.

Assumption of Costs: You accept responsibility for any and all costs of medical care and transportation arising from any injury or illness during your participation. This includes ambulance fees, medical treatment costs, and any rehabilitation. Gorilla Fight Team will not be liable for these costs.

No Liability for Aid Given: You agree not to hold Gorilla Fight Team or its staff liable for any first aid or emergency treatment provided in good faith. This includes any decision to seek external medical care. (This does not limit liability for gross negligence on the part of the gym or its staff in providing emergency aid.)

7. Release of Liability and Indemnity

To the fullest extent permitted by law, you (the participant or parent/guardian) agree as follows:

Waiver of Claims: You waive and release any and all claims against Gorilla Fight Team, its owners, instructors (including Damo and Darren), coaches, employees, volunteers, agents, and representatives (“the Released Parties”) for any injury, accident, illness, death, property damage, or other loss that you or your child may suffer arising from participation in Gorilla Fight Team activities or presence on the premises. This waiver applies even if such injury or loss is caused by the negligence of the Released Parties, another participant, or any third party, to the maximum extent allowed by law.

Exception – No Waiver of Certain Rights: Nothing in this agreement shall limit or exclude any liability that cannot be excluded by law. In particular, this waiver does not exclude or limit liability for death or personal injury caused by the negligence of Gorilla Fight Team or its staff to the extent such liability cannot be excluded under English law. Rather, this waiver is intended to document your understanding of the risks and your voluntary acceptance of those risks.

Indemnity: You further agree to indemnify and hold harmless Gorilla Fight Team and the Released Parties from any and all liabilities, claims, actions, costs, damages, or expenses (including legal fees) that may arise out of or relate to your (or your child’s) participation in the activities. This means if you, your child, or anyone on your behalf initiates a claim against the gym or its staff for injuries or losses, you will be responsible for the costs and damages incurred by the gym in defending against that claim, to the extent permitted by law.

Property Damage: You accept responsibility for any damage to the facility, equipment, or property of Gorilla Fight Team caused by you or your child through misuse or wilful act. You agree to reimburse the gym for any such damage.

8. Parental/Guardian Consent for Minors

If you are signing on behalf of a minor (under 18 years of age):

Legal Capacity: You confirm that you are the parent or legal guardian of the participating minor and have the authority to enter into this agreement on their behalf.

Agreement to Terms: You have explained the risks and rules contained in this waiver to your child in an age-appropriate manner. You and the child agree that the minor will abide by all the terms of this waiver, including the Assumption of Risk, Code of Conduct, and all other sections above.

Supervision and Responsibility: You agree that you will be responsible for ensuring the minor’s compliance with the Code of Conduct and all gym rules. If the minor’s behaviour is unsafe or violates the Code of Conduct, you understand that the gym may take appropriate action (including removing the child from an activity or terminating membership) for safety.

Liability Release on Behalf of Minor: As the parent/guardian, you voluntarily consent to the minor’s participation and waive and release all claims on behalf of the minor as outlined in Section 7. You also agree to indemnify and hold harmless the Released Parties from any claims brought on behalf of the minor, or arising due to the minor’s actions, as stated in Section 7.

Emergency Responsibility: You have provided accurate emergency contact information and will be reachable during the child’s classes when reasonably possible. You also commit to discussing with the instructors any health or behavioural issues concerning the child that could affect their safety or the safety of others.

9. Agreement and Acknowledgement of Understanding

By signing below (or by electronically accepting this waiver as part of an online booking or membership registration), you acknowledge and agree that:

Full Understanding: You have read this entire waiver (or had it read to you) and understand all of its terms. You understand the rights you are giving up and the obligations you are assuming by agreeing to this document. You acknowledge that you have had the opportunity to ask questions about this waiver and the risks of training, and any questions have been answered to your satisfaction.

Binding Agreement: You understand that this agreement is binding upon you, your heirs, next of kin, dependants, estate, and any other personal representatives. If you are a parent/guardian signing for a minor, it is binding on the minor and on you as the parent/guardian.

Electronic Consent: You agree that your electronic signature or consent (for example, checking an “I agree” box or signing via an online form) is legally equivalent to your handwritten signature on a paper copy. Whether you sign in person or agree online, you agree to be bound by this waiver in the same way.

Severability: You agree that if any part of this waiver is found to be invalid or unenforceable under the law, the rest of the waiver shall remain in effect. An invalid clause will be severed, and the remainder of the agreement will continue to be enforceable.

Governing Law: This agreement and any disputes arising from it or participation in Gorilla Fight Team activities shall be governed by the laws of England and Wales. You agree that any legal proceedings shall be subject to the exclusive jurisdiction of the English courts.
